On Friday, members of parliament from Our Party filed a request with the Constitutional Court (CMC) to review the constitutionality of the Law on the Organization and Functioning of Agricultural Chambers. The opposition believes the law requires agricultural producers to join agricultural chambers without their consent, and imposes financial and administrative obligations on them.

"This law is abusive, unconstitutional, and violates farmers' fundamental freedoms." Today, the state owes farmers approximately 4 billion lei, but instead of paying off the debt, the ruling party is passing a law requiring agricultural producers to organize. Moreover, they are being forced not only to join agricultural chambers but also to pay dues,” stated MP Alexandr Berlinschi, one of the authors of the request.

Another contested aspect concerns the uncertain legal status of agricultural chambers. Formally, they are recognized as legal entities under public law, but at their core, they are organized and function as associative structures—with membership, dues, and internal governing bodies. According to parliamentarians, this creates problems with legal certainty and predictability of legislation and is contrary to the principles of the rule of law.

Our Party MPs emphasized that “these provisions violate freedom of association, including the right not to join associations, guaranteed by the Constitution and the European Convention on Human Rights.”
